1. Introduction

Welcome to Italmineral. This website is operated by Italmineral and access to and use of the site are subject to these Terms of Service. By browsing, purchasing products or using any services on Italmineral, you agree to be bound by the following terms and conditions. If you do not agree with any part of these terms, please refrain from using our website.

Italmineral reserves the right to modify these Terms of Service at any time. It is your responsibility to review this page periodically for any updates. Continued use of the site after changes are posted constitutes your acceptance of the revised terms.

2. Use of the Site

By using our site, you agree to use it in a lawful and appropriate manner. You must not use the site for illegal or unauthorized purposes, including but not limited to:

  • Attempting to compromise the security of the site,

  • Violating Italmineral's or third-party intellectual property rights,

  • Interfering with the site's normal operations through attacks or viruses.

All content on this website, including but not limited to images, photos, logos and text, is the exclusive property of Italmineral. The use, reproduction or distribution of any materials without prior written consent is strictly prohibited.

Italmineral reserves the right to restrict or block access to the site for any user who fails to comply with these Terms of Service or who attempts to misuse the platform.

3. Products and Services

Italmineral specializes in the sale of high-quality collectible minerals. In addition to collectible specimens, we also offer tumbled stones for crystal therapy, cut and uncut gemstones, precious stones, fossils, meteorites and other related items. Prices for each product may vary over time and we reserve the right to update product information as needed. While we strive to provide accurate product photos, please note that all images are taken under professional lighting conditions. As such, slight variations in color may occur. The dimensions of each mineral are measured as accurately as possible, but minor variations (up to a few millimeters) may exist.

4. Order Process and Payment

To place an order through Italmineral, customers can select products via our online shop, add them to the cart, and proceed to checkout. Payment must be made in full to confirm the order. We also accept arrangements for in-person pickups and payments at major mineral fairs or at our headquarters. In such cases, a deposit will be required to reserve the minerals, and this deposit will be applied to the final payment.

Accepted payment methods include PayPal, credit card, bank transfer, and cash (for in-person transactions only). Orders are processed and shipped once full payment is received. If the payment is not completed, the order will not be finalized, and the goods will not be shipped. We advise customers to ensure their banks are enabled for online payments to avoid any delays.

5. Shipping and Delivery

We offer worldwide shipping with varying costs and delivery times depending on the selected shipping method, the package's weight and the destination. Additional fees may apply for shipments to remote or hard-to-reach areas, such as islands. For example, shipping to mainland Portugal may be less expensive than to the Azores. In such cases, the system might not account for this distinction during checkout and we will contact the customer to request an additional fee. If the customer declines this fee, we will provide a full refund for the order.

Italmineral is not responsible for any customs duties or taxes imposed by the destination country. Within the European Union, such charges are generally not applicable. However, for non-EU countries, these fees are beyond our control and are determined by the destination’s customs authorities.

Delivery times depend on the chosen shipping method and the destination. Generally, shipments take 2-3 business days within Italy, 3-5 business days within Europe and 3-7 business days for international destinations outside of the EU (The days are counted from the moment we receive the payment). Italmineral is not responsible for delays caused by customs inspections or the shipping carrier, but we will work closely with customers to ensure timely delivery and assist with any issues that may arise. We will provide you with the tracking code as soon as possible to help you monitor your shipment.

6. Returns and Refunds

Returns are accepted within 14 days of purchase, provided the item is returned in the same condition it was sent. If the item is returned damaged, no refund will be issued. To date, no customer has ever been disappointed and no returns have been requested. However, if needed, we kindly ask you to package the mineral carefully to avoid any unpleasant situations. Please understand that if a mineral arrives damaged, it cannot be resold and therefore no refund will be issued.

For transparency and your protection, we will record videos during the unboxing process to document the condition of the item. If an item arrives damaged, we reserve the right to request evidence of the broken mineral. We will ask for photos of the damaged item and the packaging, as damage to the external package usually indicates mishandling by the shipping service. Additionally, insurance claims with the courier require photos of the package, the label and the damaged contents.

We recommend that you, like us, record a video of the unboxing process to fully protect yourself in case of returns.

Custom items (such as handcrafted jewelry, gemstones cut specifically for you, etc.) are not eligible for returns. Once you have approved the item based on photos and videos, a return is not possible.

If the tracking information states the package was delivered, you cannot open a claim for "non-delivery." However, we will assist you in every possible way (see point 7).

7. Liability

We are not responsible for how customers use our products. Minerals are safe if handled with care and common sense, including radioactive minerals. Do not ingest, inhale or introduce minerals into your body and do not use minerals to harm yourself. In these cases, Italmineral is not responsible for improper use.

Regarding shipments: If the tracking code shows that your package has been delivered, we hold no responsibility and are not required to issue a refund. Tracking codes are generated by couriers after we hand over the package, and they contain your unique delivery information. If the address we used matches the one you provided and the tracking code shows delivery, no refund will be issued. We will, however, open an investigation with the courier to help resolve the issue, but Italmineral assumes no responsibility for fraudulent claims.

This policy exists because some individuals falsely claim non-delivery despite successful delivery, in an attempt to obtain items for free.

8. Intellectual Property

All content on this website, including but not limited to videos, photos, images, logos, the site name, text and other materials, is the exclusive property of Italmineral. The use or distribution of any content without prior written consent is strictly prohibited.

9. Terms of Service Modifications

Italmineral reserves the right to modify and update these Terms of Service. Continued use of the site after such updates implies your acceptance of any modifications.

10. Dispute Resolution

In the event of any disputes regarding the interpretation or execution of these Terms of Service, Italmineral will work to resolve the matter through mutual agreement. If necessary, disputes will be settled in accordance with the laws of the relevant jurisdiction.
